Legal basis of the processing

Art. 6 para. 1 lit. a GDPR serves my company as a legal basis for processing operations for which I obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the supply of goods or provision of another service or consideration, the processing is based on Art. 6 para. sentence 1 lit. b GDPR. The same applies to such processing operations which are necessary for the implementation of pre-contractual measures, for example in cases of enquiries about our products or services. If my company is subject to a legal obligation which makes it necessary to process personal data, for example to fulfill tax obligations, the processing is based on Art. 6 para. 1 lit. c GDPR. In rare cases, the processing of personal data may become necessary to protect vital interests of the data subject or another natural person, Art. 6 para. 1 lit. d GDPR.

Finally, processing operations could also be based on Art. 6 para. sentence 1 lit. f GDPR. Processing operations which are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary to safeguard a legitimate interest of our company or of a third party, provided that the interests, fundamental rights and freedoms of the data subject do not prevail.

 

Right of information, right of correction, blocking, deletion, objection

Information disclosure

Your personal data will not be transferred to third parties for purposes other than those listed below. I only pass on your personal data to third parties if:

  • you have given your express consent in accordance with Art. 6 para. 1 sentence 1 lit. a GDPR,

  • the disclosure pursuant to Art. 6 para. 1 sentence 1 letter f GDPR is necessary for the assertion, exercise or defense of legal claims and there is no reason to assume that you have an overriding interest worthy of protection in not disclosing your data,

  • in the event that there is a legal obligation to pass on the data pursuant to Art. 6 para. 1 sentence 1 lit. c GDPR, and

  • this is legally permissible and required under Art. 6 para. 1 sentence 1 lit. b GDPR for the processing of contractual relationships with you.

Rights of data subjects

You have the right:

  • to request information about your personal data processed by me in accordance with art. 15 GDPR. In particular, you may request information on the purposes of the processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right of rectification, cancellation, restriction of processing or opposition, the existence of a right of appeal, the origin of your data, if not collected from me, as well as the existence of automated decision making including profiling and, if applicable, meaningful information on the details thereof;

  • in accordance with Art. 16 GDPR, to demand without delay the correction of incorrect or incomplete personal data stored by me;

  • pursuant to Art. 17 GDPR to demand the deletion of your personal data stored with me, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;

  • pursuant to Art. 18 GDPR, to demand the restriction of the processing of your personal data, insofar as the accuracy of the data is disputed by you, the processing is unlawful, but you refuse to delete it and I no longer require the data, but you require it for the assertion, exercise or defence of legal claims or you have lodged an objection to the processing pursuant to Art. 21 GDPR;

  • in accordance with Art. 20 GDPR, to receive your personal data that you have provided me with in a structured, common and machine-readable format or to request that it be transferred to another responsible party;

  • pursuant to Art. 7 para. 3 GDPR, to revoke your consent, once granted, at any time vis-à-vis me. As a result, we may no longer continue data processing based on this consent in the future and

  • pursuant to Art. 77 GDPR, you have the right to lodge a complaint with a supervisory authority, without prejudice to any other administrative or judicial remedy. As a rule, you may contact the supervisory authority at your usual place of residence or work, or the place of the place where the alleged breach occurred, if the data subject considers that the processing of personal data relating to him or her is in breach of the EU's basic data protection regulation.

 

Right of withdrawal

If your personal data are processed on the basis of legitimate interests, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, if there are reasons for doing so arising from your particular situation or if the objection is directed against direct marketing. In the latter case, you have a general right of objection, which will be implemented by me without any indication of a special situation. General collection of data

When you access my website or retrieve a file, data about this process is stored in a log file on our web server. In detail, the following data can be stored:

  • IP address (if possible, this will be stored anonymously)

  • Domain name of the website you came from

  • Names of the retrieved files

  • Date and time of a retrieval

  • Name of your Internet Service Provider

  • as well as operating system and browser version of your end device, if applicable

I only store IP addresses for data security reasons, to ensure the stability and security of our system (legal basis: Art. 6 para. 1 lit. f GDPR). I reserve the right to statistically evaluate anonymous data records.

 

Cookies

My website uses cookies. A cookie is a text file that is created when a website is visited and is temporarily stored on the system of the website user. If the server of our website is called up again by the user of the website, the browser of the user of the website sends the previously received cookie back to the server. The server can evaluate the information obtained by this procedure. Cookies can be used, for example, to control the display of advertisements or to facilitate navigation on a website. Cookies are also necessary to enable the functioning of our website operation (the legal basis is Art. 6 para. 1 lit f GDPR, the protection of the legitimate interests of the operator of this website - we only use cookies in agreement with Art. 5 para. 1 lit a GDPR, i.e. in accordance with the principles of "legality, processing in good faith, transparency").

If you wish to prevent the use of cookies, you can do so by means of local settings in your Internet browser (e.g. Internet Explorer, Mozilla Firefox, Opera or Safari).

 

Contact forms

If you send me enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored and processed by me for the purpose of processing the enquiry and in the event of follow-up questions. Your data will be used exclusively for the purpose of answering and processing your question. The data processing is carried out here in accordance with Art. 6 Para. S. 1 lit. a GPDR on the basis of your voluntarily given consent. You can object to this at any time (right of withdrawal).

Links to third party websites

On this website, references to third party websites are offered in the form of so-called links or references. Only when you click on such a link will data be transferred to the link destination. This is technically necessary. The transferred data are in particular: Your IP address, the time you clicked on the link, the page on which you clicked on the link, information about your Internet browser. If you do not want this data to be transferred to the link destination, do not click the link.

 

Confidentiality of your customer access

If you have been given access to a protected area on my website that is secured by a password, you are responsible for keeping this password confidential. I ask you not to share this password with anyone.

Right to data transferability

You have the right to receive the personal data concerning you that you have provided to me in a structured, common and machine-readable format.

 

Right to complain to a supervisory authority

Without prejudice to any other administrative or judicial remedy, every data subject shall have the right to lodge a complaint with a supervisory authority, in particular in the Member State in which he or she resides, works or is suspected of having committed an infringement, if he or she considers that the processing of personal data relating to him or her is contrary to the basic EU data protection regulation.

 

Security advice

I secure my website and other IT systems by appropriate technical and organizational measures against loss, destruction, unauthorized access, unauthorized modification or unauthorized distribution of your data. A complete protection against all dangers is practically despite all care, but not in every case possible. Because I cannot guarantee complete data security when communicating by e-mail, I recommend sending confidential information by post.

 

Changes to this privacy policy

I reserve the right to change this privacy policy if the legal situation or this online offer or the type of data collection changes. However, this only applies with regard to declarations on data processing. If the consent of the user is necessary or if parts of the data protection declaration contain a regulation of the contractual relationship with users, the data protection declaration will only be changed with the consent of the user.

Therefore, please inform yourself about this data protection declaration if necessary, especially if you provide personal data.
